Terms of Use

1. Agreement and Parties

These Terms of Use ("Terms") form a binding agreement between you and the developer of Tomescroll ("we", "our", or "us"). This agreement is between you and us only — not with Apple Inc. or Google LLC. Apple and Google are not responsible for Tomescroll or its content.

Tomescroll is available through the Apple App Store and Google Play Store. Your use is also subject to the usage rules set out by the applicable store from which you downloaded the app.

2. The Service

Tomescroll is an educational app that turns Wikipedia articles into short learning cards served in a scrollable feed. A free tier provides access to a portion of each topic; a paid subscription unlocks the full library.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

3. Subscriptions and Billing

Subscription plans

Tomescroll offers auto-renewing subscriptions (Monthly and Yearly). Prices are shown in your local currency at the point of purchase and may vary by region.

Payment

Payment is charged to your Apple ID or Google account at the confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

Free trials and introductory offers

We may offer free trials or introductory pricing from time to time. Any such offer will be clearly disclosed before purchase, including its duration and the price your subscription converts to at the end of the offer period. You will not be charged during a free trial period. Introductory pricing is available once per Apple ID or Google account and cannot be combined with other offers.

Cancellation

You may cancel your subscription at any time:

• iOS: App Store → tap your name → Subscriptions → Tomescroll → Cancel Subscription.
• Android: Google Play → Account → Subscriptions → Tomescroll → Cancel Subscription.

Cancellation takes effect at the end of the current billing period. You retain access to premium features until then. We do not offer refunds for partial billing periods except where required by applicable law.

Refunds

All purchases are processed by Apple or Google. Refund requests are handled by the respective store in accordance with their refund policies. We do not have the ability to issue refunds directly.

4. Account and Access

You may use Tomescroll anonymously, or sign in with an account via Firebase Authentication. You are responsible for maintaining the security of your account credentials. You may delete your account at any time from within the app. See our account deletion instructions for guidance.

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract the source code of the app.
• Circumvent or attempt to circumvent any access controls or subscription restrictions.
• Use automated tools or bots to access or scrape the service.
• Resell, sublicense, or otherwise distribute access to the service itself (sharing individual cards via the in-app share feature is permitted under the CC BY-SA 4.0 licence described in Section 6).

6. Intellectual Property

The Tomescroll app, branding, feed algorithm, and user interface are owned by or licensed to us and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to use the app for personal, non-commercial purposes.

Card content is derived from Wikipedia articles and is therefore published under the Creative Commons Attribution-ShareAlike 4.0 International licence (CC BY-SA 4.0). Each card identifies its source Wikipedia article; content is credited to its Wikipedia authors. You may share and adapt card content provided you give appropriate attribution and distribute any derivative works under the same CC BY-SA 4.0 licence. Wikipedia is a trademark of the Wikimedia Foundation.

7. Disclaimer of Warranties

Tomescroll is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

Card content is generated with the assistance of AI and derived from Wikipedia. While we aim for accuracy, we make no representations about the completeness or correctness of any educational content in the app. Do not rely on it as your sole source of information.

8. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Tomescroll, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Product Claims

We, not Apple or Google, are responsible for addressing any claims you or any third party may have relating to Tomescroll, including product liability claims, consumer protection claims, and claims that the app fails to conform to applicable legal or regulatory requirements.

10. Intellectual Property Infringement

If you believe any content in Tomescroll infringes your intellectual property rights, please contact us at legal@tomescroll.app with details of the alleged infringement.

11. Export Compliance

You represent and warrant that you are not located in a country subject to a UK, EU, or US government embargo or designated as a "terrorist supporting" country, and that you are not listed on any UK, EU, or US government list of prohibited or restricted parties. You agree to comply with all applicable export control laws.

12. Third-Party Beneficiary

If you downloaded Tomescroll from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your country of residence provide otherwise.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "last updated" date at the top of this page. Continued use of Tomescroll after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the app and cancel any active subscription.
